But if you change it a little and call it something else they can't hurt you right?
Besides as long as the person who's selling it isn't makeing a profit they can't do anything either.

^By my understanding changing little bits of your prop will not make selling it any more legal. If the overall piece looks like a "Proton Pack" then you can't legally sell it.
Whether you make a profit or not is irrelevant. What matters is whether or not the actual Copyright holder feels that he/she is losing money and/or is in some way being hurt by your actions.

but if i were to pay you money to get the parts for it it could be like asking my dad to make it for me but then re-embursing him the money he paid for the supplies. could they sue me then? i'm not tryin to be a jerk i'm 16 and just want to know about this stuff.

i highly doubt sony would sue you. at the most, you would get what's called a cease and decist order.

I'm pretty sure that you won't get into any trouble for making props for yourself otherwise Halloween would be a corporate nightmare...that and regulating such a thing would be next to impossible.
I'm having a little trouble understanding what you're trying to ask but it may be because I'm really tired at the moment.
If your talking about buying parts from a hardware store and then using them to build a pack for yourself; then no, it's very unlikely that you're going to get into any legal trouble (even though technically I think it is still considered a violation of Copyright law).
If you're talking about actually paying someone, selling, or being paid to create replicas of someone else's creations without the Copyright holder's permission; then "yes" that is a violation of Copyright law and "yes" it is illegal.
Will you get into any legal trouble? In this particular case, probably not, unless you're planning on making a business out of it.
Can you get into trouble though? "Yes".

it all depends on the company holding the copyrights, i mean look at gorege barris (spelling is prob wrong) he desgined and created the adam west batmobile, and well some guy created a replica of it and was taking it to car shows and drving it around adn gorege barris found out and took legal matters and they took the guys car away. so u can always get in trobel. but as long as u dont sell them outright most comapnys dont care.

yeah, there's usually always a replica pack on ebay. as long as you don't mass produce and sell them, you'll probably never catch any trouble with it. sometimes, though.... ebay pulls film prop replica auctions if the item isn't licensed.

I'm just sayin if someone makes it and they decide to sell it but don't ask anymore than what they payed to get the materials for it than it could be like i'm asking my friend to make it for me and i'll pay him afterwards for the mateials he used for it.

It would still be "technically" illegal.
Not just because you sold the pack (again the amount you sell it for is irrelevant...you could sell it for a penny and it wouldn't change anything) but also because you created it in the first place.
The primary function of a Copyright (the name says it all) is to make sure that the original creator has a say in who gets to do what with his or her creations (i.e. who has the "right to copy").
Copying someone else's work without permission is illegal (with some exception), therefore selling a copy of someone else's work without permission is illegal.
Here, check these pages out, they don't really discuss instances with props but they will give you an idea as to how Copyright works...

ok thanks. do you think that out of all the stuff from the movie though that they would have a copyright on the pke meter? if i were the copyright owner i'd make shure i put one on the car more than any other prop. and look how people have made their own ecto mobiles out of 59 caddys that look just like the one in the movie. they havn't gotten in trouble. i know though that if the copyright owners wanted to they could sue but i don't think thet would.

yes there is a copyright on the pke...if im right either modern props holds it which ib elive they do or the guy who built it does. theres one on ever gb prop, most companys dont care waht u do as long as ur not massproducing them or amking a profit off them. im curently making a batmobile replica and im gonna use it in some shows im gonan do, but there shows for childreen hospitals and orpahges, but im not making any moneyoff them so i dont think i will have a prob, but im gonna check with wb just to make sure. if they say no...im gonna do it anyways, cuz they will just look bad if they stop me after ive done it, but if they say yes, they will prob want me to prmote wb which i have no probs with, but this is getting way off corse, the main point is as long as u dont mass produce them or amke a huge profit off them most companys wont care, at the most they will give u a cease and decist order as d_osborn and if u dont cease and decist after they give u the order then they will prob sue.
